The following terms and conditions are valid between you and Archivio s.r.l. and applied to all orders, placed both on Archivio website (archiviowebsite.com) and by telephone or e-mail. Archivio reserves the right to suspend or discontinue the sale of an item. Orders may only be placed by people of legal age. Archivio reserves the right to revise the selling ‘terms and conditions’ at any time. Each purchase is subjected to the terms and conditions version in effect on the date you submitted your order. Please check for the latest before making your purchase. You can find the date of the latest update in the final section of the ‘terms and conditions’ paragraph. Please note that the terms and conditions applicable to your order are always the terms and conditions you read and agreed to before placing your order and not a later version. You should retain a copy of these terms and conditions for future reference.

3. PLACING ORDER

By using the website and/or placing an order on the website, by telephone or e-mail, you confirm that you have read these terms and conditions and the privacy policy, and that you accept them. Please make sure that you have read and understood the terms and conditions before you place an order. An order can only be placed if you have previously confirmed that you accept these terms and conditions. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, and the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the website to fail, your selection of products may be lost. in such case, you will be required to re-enter your selection of products to the shopping bag.

5. ACCEPTANCE AND SHIPPING CONFIRMATION

Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order and these terms and conditions. The shipping confirmation is our acceptance of your order. Please note that Archivio does not guarantee that all products presented on the website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. If we already have received payment for such product we will refund you the amount of the purchase.

6. COLORS

Archivio goal is to describe the products at the website as correctly as possible. However, please note that due to the color settings of your computer, the colors of the products shown in the pictures on the website can differ somewhat from their actual colors. Archivio cannot be held responsible for any such discrepancy.

Archivio.com accepts the following payment methods:

Credit Card: All major credit cards including Visa, Visa Electron, MasterCard, Maestro, American Express.

Your card will be debited when the order is placed.

PayPay: Simplify your checkout process using PayPal’s digital wallet.

8. TAX INFORMATION

Sales Tax is applied to your order in accordance with individual state and local regulations.

We collect sales taxes in all applicable states.

For this reason, an estimation of the tax charge may be added to your order total during the checkout process. Exact charges will be calculated automatically after your order is shipped, depending on the Zip Code of your shipping address. The final amount will be equal to or less than the estimated Sales Tax shown to you at checkout. The final Sales Tax applied to your order will be indicated in the Shipping Confirmation email.

9. PAYMENT SECURITY

We do our best to make the website as secure as possible. All credit/debit card transactions on the website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account once you place the order. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Archivio, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

10. SECURITY

Archivio use secure socket layers (ssl), the industry standard in transferring information to process your orders. Archivio online shop secures communications by encrypting all data to and from the site. When placing an order, you can immediately check the security validity by clicking the thawte icon at checkout. For security reasons, we do not store any payment information in our database.

11. SHIPPING METHODS

We offer different shipping methods to meet your needs as further specified when you check out. Dispatch of orders may take up to 15 business days as we produce the order only on your purchase request. The delivery times do not take into account possible delays caused by payment authorization and/or on the part of the shipping company. If Archivio fails to deliver within 45 days, you have the right to cancel the purchase.

12. INFORMATION OF THE RIGHT OF REVOCATION

It is not possible to request a change or a refund of a customized product unless the goods are defective or not in conformity with the order placed.

13. RETURNING THE PRODUCT

As Archivio sells on a Made-To-Order business model, we cannot offer a return or refund if you change your mind or if the item/s does not fit. Each piece is carefully crafted and handmade once your order has been placed. A lot of time and care goes into making each piece, so please be considerate when placing your order.

If for whatever reason you are unhappy with your purchase I do offer alterations at an additional cost, please email info@archiviowebsite.com within 7 days of delivery and a return address will be provided to you.

For alterations and exchanges it will always be the customer’s responsibility to safely post items back to the studio with a trusted tracked service, this cost is not worked into the price of garments and must be covered by you. 

14. DEFECTIVE PRODUCTS

For any defect of conformity existing upon delivery of the products, you will benefit from any mandatory provisions of, and legal rights available to you under, the laws of your country. Notwithstanding of the above, if you receive defective products, please notify us immediately. If Archivio considers the products to be defective, Archivio will make a full refund including shipping costs. Any other rights you may have shall remain unaffected. Additional guarantees with respect to products of Archivio will apply only if expressly stated in the shipping confirmation.

15. REFUNDS

Once your return shipment reaches our warehouse, please allow up to 10 business days for your return to be processed and refund issued. Once your return has been accepted, we will process your reimbursement and send you a Refund Confirmation email. 

The time needed to process your refund may vary based on the payment method used:

If you have received a Refund Confirmation email but have not been refunded please contact your bank. If your bank is unable to locate your refund please contact Customer Care.

Archivio reserves the right to apply all available measures against any violation of these terms and conditions, including the right to block the access to the site.

23. LIABILITY

Any damage liability of Archivio is excluded. Exempted from this exclusion are claims of the customer related to damages to health, body and mind, or damages resulting from a violation of material contractual obligations (cardinal duties), as well as the liability for other damages which are based on intent or gross negligence of Archivio, its representatives and vicarious agents. Material contractual obligations are obligations which are precondition to the successful performance of the contract and on the observation of which the customer can legitimately rely. In the event of a violation of material contractual obligations, Archivio liability is limited to the foreseeable and typical damage if such damage has been caused slightly negligent, unless a damage to health, body and mind is concerned. The limitations set forth above also apply for the benefit of the representatives and vicarious agents of Archivio if claims are made directly against them. The liability under the product liability act remains unaffected. Archivio assumes no liability in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. In case of force majeure, Archivio obligations will be suspended. The contract between you and Archivio can, in such cases, be partially or fully terminated by yourself or by Archivio.

If any part of these terms and conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these terms and conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these terms and conditions.

25. GOVERNING LAWS

These terms and conditions are ruled by Italian law (excluding the United Nations convention on contracts for the international sale of goods – cisg). However, if you are a consumer and you are resident in any other country of the European Union, you will benefit from all mandatory provisions and legal rights in force in that country. Nothing in these terms and conditions shall affect your rights as a consumer to rely on these mandatory provisions of local law and statutory rights. Please note that the European commission has set up the ODR platform for the out-of-court settlement of disputes relating to contractual obligations arising from contracts for online sales or services between a consumer and a trader respectively resident and established in the European union.
